Welcome to Yaeltex. This document explains the rules and guidelines for using our website (yaeltex.com) and our "Factory" design application. By using our site and services, you are agreeing to these terms. Please read them carefully.

Using Our Website & Services

• Service "As Is": Our website and services are provided as they are, with all their features and potential faults. We do not offer any guarantees and reserve the right to modify, suspend, or terminate any part of our service at any time.
• User Account: To use certain features, like the Factory designer, you must create an account and agree to these terms. We reserve the right to cancel any user account at our discretion.

Designing & Ordering Custom Controllers

This is the most important section to understand when creating your own controller.

• Your Design & Our Intellectual Property: When you design a custom controller using our Factory, the intellectual property (IP) of that final design template belongs exclusively to Yaeltex. This means we have the right to use, modify, reproduce, and sell that design. You grant Yaeltex a worldwide, irrevocable, and royalty-free license to all rights associated with the custom controller design you create on our platform.
• Prohibited Content: You are not allowed to use copyrighted logos or third-party trademarks in your design. As the user, you are solely responsible for any content you upload and for any legal repercussions that may arise from its use.
• Our Right to Reject Designs: We reserve the right to reject any custom design that violates our rules, our community standards, or that we deem technically unfeasible.

Shipping, Delivery & Acceptance

• Shipping Times are Estimates: Our shipping timeframes (e.g., 35-55 business days for worldwide shipping) are estimates that begin once your payment is confirmed. Delays can happen due to causes beyond our control (such as customs or carrier issues). You agree not to make claims against Yaeltex for such delays.
• Shipping Carrier Responsibility: Once your controller is handed to the shipping carrier (e.g., FedEx, DHL), they are responsible for its safe transport. Yaeltex is not liable for any damage, loss, or deterioration that occurs during the shipping process. Any claims for such issues must be made directly to the shipping carrier.
• Inspect Your Product on Arrival: You must verify the condition of your controller immediately upon delivery. Accepting the package from the carrier implies your full compliance and acceptance of the product's condition.

Warranty & Technical Support

• One-Year Limited Warranty: Yaeltex custom controllers come with a one (1) year limited warranty that covers manufacturing defects. This warranty is transferable if the product is sold to a new owner within the warranty period.
• Repairs Outside of Warranty: If your controller has an issue that is not a manufacturing defect (e.g., damage from use), we offer a technical repair service. The cost will be quoted based on the work required.

Your Responsibilities as a User

When using our site, you agree not to:

• Engage in any illegal activities.
• Post or distribute any hateful, discriminatory, defamatory, or pornographic content.
• Alter, hack, or damage our website, or introduce viruses or malware.
• Use automated systems ("bots," "spiders") to excessively access our servers.
• Collect personally identifiable information from other users.

The Fine Print: Legal Information

• Third-Party Links: Our site may link to other websites. We are not responsible for their content or policies.
• Governing Law: These terms are governed by the laws of the Argentine Republic. Any legal disputes will be handled exclusively in the Ordinary Commercial Courts of the City of Buenos Aires.

At Yaeltex, we believe creation is a political and social act. The freedom of our design tools allows for almost anything to be materialized, so it is important for us to be clear about the values we support.

We defend freedom of expression in the pursuit of an open and tolerant culture. We repudiate any discriminatory, racist, or hateful message that we consider hurtful, and we reserve the right to reject any design that promotes such content.
